ABSTRACT

The law of tort deals with people’s obligations towards each other – to refrain from harming others, or, if harm has been done, to either repair it or compensate for it. Trespass to the person consists of the torts of assault, battery and false imprisonment. Claims of unlawful assaults by police officers are usually conjoined with other torts and so there are few cases that examine the question of assaults by police officers as single issues. Breach of confidence is a tort used to provide protection against the disclosure or use of information that the owner has not placed in the public domain. The tort of negligence is the breach of a legal duty of care which results in damage, to the plaintiff. The standard of the duty of care demanded by law is sometimes described as an objective standard, this is the standard achieved by most people undertaking the particular task.
