ABSTRACT

This chapter explains the relationship between the superior and the inferior proprietary land unit. The duration of all inferior units is primarily determined by the life of the superior unit out of which they are carved, no matter what form the inferior unit takes. From its very nature and the relationship between the two units an inferior unit must always be contained within the time limits of the superior unit as they are foreseeable at the time when the inferior unit is formed. Duration is an attribute of the proprietary land unit of primary importance to the planning and use of its resources. And time is in the gift of the holder of the superior unit. An inferior proprietary land unit carved out of a superior one is complete in all its attributes, abstract and physical. The fictitious proprietary character form is an artefact of law, a synthetic personality built up by a charter of incorporation or some other convention.
