ABSTRACT

This chapter sheds light on various significant laws and rules which basically protect the rights of the juvenile. The relevant articles of the Constitution of India and the provisions of the Juvenile Justice (Care and Protection of Children) Act, 2015 have been discussed in this chapter. Further, sections 82 and 83 of the Indian Penal Code grant immunity to an infant below a particular age from criminal responsibility. Section 82 absolves a child under seven years of age from criminal responsibility, whereas section 83 grants partial immunity against prosecution and punishment for a child above seven and under twelve years of age. These provisions are critically analyzed with the help of judicial pronouncements.
