ABSTRACT

This chapter highlights key provisions of the Juvenile Justice (Care and Protection of Children) Act, 2015. This Act provides for strengthened provisions for both Child in Conflict with Law and Child in Need of Care and Protection. This Act also mandates the setting up of Juvenile Justice Board and Child Welfare Committees in every district, respectively. A preliminary assessment conducted by the Juvenile Justice Board plays a crucial role in determining the mental and physical capacity of the juvenile at the time of the commission of offence. The procedure of preliminary assessment has been discussed in this chapter.
