ABSTRACT

Apart from legal norms (substantive criminal law and criminal procedure law), institutional and ethical judicial conscience are important paths to substantive criminal liability. In the midst of tremendous social change in China, a series of controversial criminal judgments have led to heavy bombardment of judicial justice from the public. This situation has made legal professionals restless and the rule of law in question. How to face these controversial criminal cases also determines the attitude of a conscientious criminal law scholar toward oneself and others.
