ABSTRACT

This chapter explains the main aspects of the European Union (EU) cross-border insolvency law and the aims of this work. The EU cross-border insolvency law is part of the EU law which contributes to the functioning of the internal market and is closely connected with the exercise of the fundamental freedoms such as freedom of establishment and movement. This chapter presents the main questions and aims of this work, namely, how to enhance the effectiveness of insolvency proceedings. Effectiveness is a goal and a challenge of insolvency proceedings which requires finding a proper balance between the interests of the involved persons. This chapter also describes the structure of this work and which legal sources have been analysed.
