ABSTRACT

In recent years, a number of journalists, academics, activists, NGOs and political persons have demanded the complete abolition of the law of sedition. They claim that there has been rampant misuse of the law across the nation, by the central government as well as by state governments, to curb free speech and expression, and especially the press. On the other side of the spectrum, officers of the Court, most notably Attorney General K.K. Venugopal, have asserted that it is important to retain the law on the statute book, though there can be some legal safeguards to balance the needs of national security and free speech.
