ABSTRACT

This chapter begins with brief anecdotes about James Washington, John Pace and Terence Lewis, all former juvenile lifers. These anecdotes serve as an introduction to the main topic of the chapter: Detailed histories of both the Miller and Montgomery decisions and, more importantly, what they mean. The important court cases involving juvenile sentencing prior to Miller and Montgomery are discussed before the oral arguments are described for both the Miller and Montgomery cases. The judicial opinions offered by the U.S. Supreme Court for both of these cases are analyzed before there is a discussion of the challenges to both Miller and Montgomery are briefly explored.
