ABSTRACT

This chapter continues the effort to describe in more detail how various prosecuting attorneys processed the handling Miller cases, particularly after it was clear that they had little choice. The prosecuting attorney in Wayne County, Kym Worthy, Michigan, tells about her elaborate procedure for deciding how to deal with the resentencing hearings of juvenile lifers. Other prosecutors are heard from as well. And the procedures from other prosecutors illustrate how different states and different counties within states handled these hearings. Since the former attorney general of Michigan led a number of other states in actively opposing Miller and Montgomery, there is a discussion of his legal maneuverings to try to undermine Miller. The chapter ends by showing how Philadelphia went about holding a great number of resentencing hearings.
