ABSTRACT

Chapter 4 examines whether the use of streaming should be exempted from copyright infringement through the use of statutory defences and limitations, such as fair dealing and the temporary copy exception. More precisely, it argues that the end-user’s acts of streaming can be exempted from copyright infringement because such acts fall within the scope of current defences. Given that transient copies are made in the streaming process, this chapter further explores whether the use of streaming could be subject to the temporary copy defence.
