TO the real right the Romans opposed, under the name of obligatio, the personal right defined as a legal bond constraining one person to do something or leave something undone in the interests of another; 1 and as they generally attributed to this prestation, whether positive or negative, a pecuniary value, the personal right also constituted an element in the patrimony.
