ABSTRACT

T He Criminal Justice Act of 1948 follows the tradition of the Prevention of Crime Act 1908 in placing young offenders and persistent offenders next door to each other. The statutory framework of the Borstal system is entirely contained within section 20, preceding section 21 on persistent offenders, and the Second Schedule to the Act: the Act of 1908, and the amending sections of 1914, are entirely repealed.
