Fittings These are items which may be fitted either by the landlord or the tenant: examples might be light fittings and carpets. They will normally remain in the ownership of the person who fitted them. The legal test is whether the item is fitted in such a way to the premises that it becomes attached to it or whether it is removable without damage to the building. If it is so removable then generally it will remain in the possession and ownership of the person who fitted it.

Young v Dalgety pIc (1986) 281 EG 427 By a term of the lease the landlord required the installation of light fittings and the laying of a carpet floor covering which was attached to the floor by gripper rod fittings. The question before the court, at the time of the rent review, was whether the value attached to the light fittings and the carpets should be disregarded as being tenant's fixtures.
