Definitions in a lease It is probably worth pointing out at this stage that the statutory definition of service charges contained in section 18 of the 1985 Act will override any individual definitions in a lease. A landlord cannot escape the constraints of the service charge legislation by relying on a provision in a lease for example that insurance is dealt with separately from the service charge. The insurance must still be in a reasonable amount, and expenditure on it must be supported by adequate documentation made available on request. The same applies to any other form of expenditure to which a leaseholder is expected to contribute so long as it is listed in the heads of expenditure referred to as 'relevant costs' in section 18.
