ABSTRACT

This chapter identifies the principal roles in buying and selling property. It describes the methods of transfer and compulsory purchase procedures. The chapter discusses how to protect retained property and examines conveyancing and land registration. It seeks to delve into the practices and procedures by which property passes from one person to another. Property is usually sold on the open market by the owner engaging an estate agent to act as intermediary. Tenders are often invited when the seller or prospective landlord wishes to “control” the outcomes after the disposal. Where the property is being purchased as a whole or in part under a compulsory purchase order, the seller will normally engage a professional valuer to negotiate, not only the sale of the property but any entitlement to disturbance or other items of the claim. The formal creation, transfer of extinguishment of an estate or interest in land, i.e., conveyancing is usually the responsibility of a solicitor or licensed conveyancer.
