ABSTRACT

The activities and procedures dealt with in this chapter represent what is traditionally the major part of the work of estate managers. It is not proposed to approach the subject from either a legal or valuation standpoint, but one which endeavours to identify decisions the estate manager needs to take in relation to individual leases, and the factors to be considered. Some of the main matters to be considered (from the points of view of both the landlord and the tenant) in arriving at a strategy are set out in Appendix B. As in previous editions of this book, only a limited amount of case law has been mentioned, because, as well as referring to the many legal texts, it is now possible to search a number of databases of case law on the Internet. One such subscription service is the Westlaw UK Landlord & Tenant online resource, which includes Woodfall: Landlord & Tenant, and the Landlord & Tenant Review. It offers an authoritative source of case reports and legislation but with the additional advantage of being updated daily and providing extensive search functions. Another extremely useful source of case law and articles is to be found in EGi from Estates Gazette. The valuations required by estate managers are not complex but are best approached within the discipline of a clearly developed conceptual base rather than as ad hoc aspects of estate management.
