Those provisions apply to the whole or part of a building containing two or more flats held by qualifying tenants so long as the number of flats held by such tenants exceeds 50% of the total number of flats contained in the premises. However the requirement does not apply where more than 50% of the internal floor area of the premises (in aggregate) is occupied or intended for occupation otherwise than for residential purposes. Therefore the requirement would not apply to flats above shops where the internal floor area of the shops below exceeds that of the flats above.
