ABSTRACT

This chapter explains the procedures which have to be followed if a land owner/occupier is to recover compensation as a result of his land being subjected to a necessary wayleave, a compulsory purchase, at a loss of development value, or an easement. The principles of valuation and the statutory context in which the amount of compensation is calculated are set out in the compensation code contained within section 5 of the Lands Compensation Act 1961. The Tribunal is a court of law and a right of appeal on points of law exists from its decisions. The Lands Tribunal will manage a reference under 1996 Part IV in accordance with one of four procedural codes, namely: the special procedure, the simplified procedure, the standard procedure and the written representations procedure. The chapter concentrates on the three rules which the Lands Tribunal operates in relation to its own proceedings.
