ABSTRACT

Our proposals in this chapter build upon earlier work by others. The earliest argument for reforming the law on utilities which we have been able to find is in an RICS research paper of December 2000 produced by Norman E Hutchinson and Professor Jeremy Rowan-Robinson of Aberdeen University. Earlier work was undertaken by Barry Denyer-Green in 1999. 1 This chapter provides an overview of the historical background, and present day application of utility rights. It goes on to provide a brief summary of the various utilities outlining the legal anomalies that occur as a result of the different legislation under which they operate and the changes that have occurred with utilities generally. It concludes by arguing for reform of the legal processes if there is to be fairness and uniformity.
