ABSTRACT

In Chapter 2 on contract law, it was first explained that a contract is an agreement between two or more persons which is enforceable by law. One of the first comments which must be made regarding the legislation on the sale of goods, is that it will only apply where there is a contract in force, and only the parties to the contract can sue for breach of that contract. Looking back again to the chapter on contract law, it is explained that the Sale of Goods Act 1979 (as amended by the Sale and Supply of Goods Act 1994), implies terms into contracts for the sale of goods which entitle a party to the contract to sue for breach of contract if any of these implied terms are breached.
