ABSTRACT

General average losses include, general average sacrifices and general average expenditures. Losses which qualify for claims for general average contributions are commonly said to be "admissible" or "allowed" in general average and, therefore, referred to as "allowances". Not surprisingly, many of the York-Antwerp Rules are framed to make specific provision for losses which shall or shall not be treated as general average losses. The York-Antwerp Rules also define, enlarge or restrict the qualifying losses. The York-Antwerp Rules provide for the exclusion of losses occurring outside the common adventure, for which the shipowner should be responsible, even though it is necessary to remedy those losses for the safe prosecution of the voyage in issue. Rule F does not authorise claims for losses incurred in substitution for allowable general average expenditure or, indeed, expenses incurred in substitution for putative losses which would have been incurred, and allowed in general average.
