ABSTRACT

In his later years, Kawashima Takeyoshi showed much concern about China's legal system by actively supporting the activities of the Sino-Japanese Economic Law Center and its affect. Kawashima's idea of taking legal consciousness as a variable to explain the behavioral pattern of law was formed in the 1950s and fully unfolded in his booklet Legal Consciousness of Japanese People, first edition in 1967. The principle of social order lies in harmony with the traditional cultural consciousness. Thus Kawashima believed that culture is somewhat interdependent on structure, as consciousness relies on institutions. As a modern torchbearer, Kawashima particularly stressed the rule of law and law-abiding, as well as the consistency of law and ethics. In Kawashima's theory, there's no strict distinction between science and techniques. He basically uses the concept of the science of law in defining such meanings as control technology, language technology, forecasting techniques, and techniques of dispute settlement.
