ABSTRACT
In this chapter, we discuss several challenges and potential barriers that must be considered in applying the framework introduced in the preceding chapter. Since tort law is central to the model we present, and because tort law has not yet been widely accepted or used in advancing claims for racial discrimination or harassment, we focus on the potential issues associated with following that path to redress for racism, and then discuss other paths as well.
