ABSTRACT

This chapter sets out the considerations to bear in mind when dealing with law, the lawyers and others for advice and assistance. There are several different categories of advice and assistance to consider. It includes advice on commercial matters, such as market intelligence, insurance, export or import requirements and procedures; advice and assistance in putting the contract together, writing the contract conditions, preparing designs and specifications and other documents; and advice on contract law and contract interpretation. It also includes advice and assistance in dealing with contract problems or claims; and advice and assistance in dealing with formal disputes procedures, litigation, arbitration and so on. The sources of advice include commercial advice, contract meaning, contract problems and contract disputes. For choosing an advisor, we need to look for the following: experience, theoretical knowledge, practical knowledge and track record.
