ABSTRACT
Contractor’s Equipment is defined earlier in the general Conditions of Contract. There should be a separate instruction directing the Contractor to supply/issue a Document, which will eventually form part of the Contractor’s Documents to the Engineer as they come into existence, then Engineer will then review the Documents. That separate provision would then ensure that the Documents remained with the Contractor until completion of the Works. The Contractor shall disclose all confidential and other information as the Engineer may reasonably require in order to verify the Contractor’s compliance with the Contract. The Contractor and the Employer shall, in performing the Contract, comply with all applicable Laws. The total liability of the Contractor to the Employer under or in connection with the Contract, other than: This Sub-Clause shall not limit liability in any case of fraud, gross negligence, deliberate default or reckless misconduct by the defaulting Party.
