ABSTRACT

This chapter considers the evaluation of existing national legal frameworks for urban management and development in the light of The Habitat Agenda and the promotion of new or amended legal frameworks to reflect and advance that Agenda. The law aim to create a clear Tanzanian statutory framework for the operation of a market for land. The new land law provides a legal framework for the operation of a market in land. Land markets function as part of the private sector of the economy and the principal actors which make the market work are themselves part of the private sector; lawyers; estate agents; surveyors; and lenders of funds. The fundamental principle that all land is public land and as such vested in the President as trustee for and on behalf of the citizens of Tanzania is maintained as the bedrock of the land law.
