ABSTRACT

Freedom of expression must be realized. Therefore, it is decisive that a public space exists in which freedom of expression can be realized. It is, however, only in a democratic society that freedom of expression can be secured institutionally in a public. The free exchange of ideas and opinions is one of the most valuable human rights. Therefore, each citizen can speak, write and publish freely, under the condition of responsibility for misuse of this freedom in cases laid down by law. The paradox of the administrator's freedom of expression from a legal point of view can be seen as a clash of rules between, on the one hand, the legal rules with regard to freedom of expression and, on the other hand, the legal rules governing the administration's hierarchy of command. In the ethical public space, all members of the institution should have opportunity to put forward their objections against specific motions in the administration on an equal basis.
