ABSTRACT

Aviation activities cross the boundaries of countries, enter foreign jurisdictions and operate in different legal systems. Therefore, there is a need for international standardization of procedures and practices and for unification and/or coordination of regulations on the global scale. This chapter reviews the development of international aviation regulations and discusses future issues facing the Asia Pacific air carriers and governments. It discusses the US open skies initiatives towards the Asia Pacific countries, and their implications for carriers and governments. The European Union has been active in deregulating its internal market through the adoption of the several packages for liberalization. One of the most significant issues facing commercial aviation under the bilateral system of negotiation was the resulting imbalance in the distribution of international traffic. ‘Safety Net’ is extraordinary measures to ensure a fair competition in achieving a gradual, progressive, orderly and safeguarded liberalization of the international air transport market.
