ABSTRACT

As we saw in the previous chapter, avoiding illegal employment discrimination is a critical aspect of human resource management. That chapter discussed the legal issues involved in hiring, promotion, and termination decisions and in determinations regarding compensation and employee leave. Here in Chapter 7, we explore several other forms of illegal employment discrimination, such as harassment and discriminatory responses to different forms of employee expression. In particular, this chapter discusses sexual and racial harassment in the employment context and discriminatory treatment of employees for engaging in different forms of expressive activity. These may include seeking justice under antidiscrimination laws, whistleblowing, dress or grooming choices, engaging in speech while on the job, observance of religious practices, and unionizing activity.
