The 1924 Rule had been criticised for stating a truism, in that it merely repeated settled law in all countries. The Association Internationale des Dispacheurs Europeens (AIDE) passed the question to one of their working groups and in the event the General Assembly at Prague in September 1993 approved a proposal to recommend the following text as an addition to Rule E. All parties claiming in general average shall give notice in writing to the average adjuster of their claims in general average within 12 months of the date of the termination of the common maritime adventure. In recent years insurers have become increasingly concerned that recoveries from third parties in relation to insured losses are pursued and credited to claims appropriately. As regards to the "cut-off" provisions in detail, claimants and contributors have a period of 12 months in which to supply details of their claim(s) and particulars of value.
