ABSTRACT

In 1890 the following Rule was proposed and agreed to without discussion: No deductions "new for old" shall be made from the cost of temporary repairs of damage allowable as general average. Nothing was said as to the circumstances in which the cost of temporary repairs would be admissible in general average. This question would continue to be determined in accordance with the law and practice at the "place of adjustment". Laurence R. Baily was a highly respected average adjuster practising in Liverpool in the mid-nineteenth century. In 1851 he wrote a treatise entitled "General Average, and the losses and expenses resulting from General Average Acts, practically considered", and in 1854 he published a second edition of his work. In 1869 he was a founder member of the Association of Average Adjusters, being elected its chairman on two occasions: in 1870 and 1880.
