ABSTRACT

The International Working Group (IWG) met in Copenhagen on 21 March 2012 where the principal issues for discussion were the provisions of Rule VI and Rule XI(c). In addition, it was proposed that a Rule of Application be included to make it clear that these new Rules, referred to as the York-Antwerp Rules 2012, should be considered as an amendment of earlier rules. The Colloquium included a presentation by Professor Dr Didem Light on how general average concepts have developed across maritime countries and jurisdictions and a review of the progress being made towards the York-Antwerp Rules 2016 by three average adjusters Richard Cornah, Michael Harvey and Jonathan Spencer, all members of the IWG. A pre-conference meeting of the IWG was held on 3 May to discuss refinements to the drafts to be considered by the International Sub-Committee (ISC). It was during this meeting that the French delegation expressed their profound opposition to the proposed Comité Maritime International (CMI) Guidelines.
