Advocate General Ives Bot invited the Court to dismiss Ireland's action.57 He argued that the Directive 2006/24/EC is intended to improve the conditions for the establishment and functioning of the internal market and is therefore correctly based on Article 95 EC. The European Court of Justice recently announced its decision on the 10 February 2009. It rejected Ireland's action of nullity, which means Directive 2006/24/EC remains valid and is applicable law.
