ABSTRACT

There are three strong messages in this case, the first two being especially significant for designers.

It is not enough to rely solely on certificates of conformance to international Standards when working on consumer products. All due diligence must be exercised and all reasonable steps taken.

A consumer product must be more than just inherently safe. It must be safe in the circumstances in which it is to be used.

Importers have a duty to exercise all due diligence in respect of safety, even if they do not actually handle the product themselves. It is not enough to rely on paperwork.
