ABSTRACT

The concept of title includes a number of different rights for the person who can show that he has title to the asset at issue. As such, title protects the person from a claim by another person in respect of that asset. The dilemma under Swedish law is how can one define title? Probably, this question can only be answered negatively, that is, the owner can only be prevented from exercising his right to utilise the property if he himself has placed limits on the title or that the limitation is a direct result of legislation. Generally speaking, the concept of title is a relative concept which has been formed in accordance with the laws and regulations applying when title is claimed.
