ABSTRACT

Humanbeingsrelyonthecognitivecapacityofreasoninginallsortsofendeavours.Reasoningcomesindifferentkinds.Inethicsandthelaw,modes ofreasoningaredistinctfortworeasons.First,merecanonsofpurelogic donotsufficetocharacterisereasoninginethicsandthelawsincemodesof reasoningshouldbetailoredheretopracticalsettings.Second,normative modesofreasoningforguidinghumanbehaviourareatcentrestage.Becausereasoningtakesapractical,normativeturninethicsandinlaw,these areassharemuchmethodology,andtheyaddresssimilarproblems.This volumechartstwosharedproblems,therelationbetweenprinciples,rules andparticularjudgements,andtheroleoffactsandfactualassertionsin normativesettings.ThecontributionsinpartIdealwiththefirstproblem.
