ABSTRACT

Following the Middle East conflict in 1967, the States concerned appointed representatives for cultural property, together with Commissioners-General, in accordance with the procedure laid down in the Regulations for the Execution of the Convention. The idea of establishing a list for the appointment of the commissioners is to be found in the Regulations appended to the Preliminary Draft Convention of 1938. The Commissioner is chosen from the international list of persons, compiled in accordance with Article 1 of the Regulations, by joint agreement between the Party to which he will be accredited and the Protecting Powers acting on behalf of the opposing Parties. In accordance with the amendment proposed by the United States, the reference to the security of the State was strengthened, in particular by stipulating that the control bodies shall 'in all circumstances be guided by the requirements of the military situation as communicated to them by that High Contracting Party'.
