ABSTRACT

Ambiguity in the terms of the environmental impact assessment (EIA) Directive has given rise to problems of European Union Environmental Law: An Introduction to Key Selected Issues implementation in most Member States. It is intended that the International Commission for IA (ICIA) provides advisory assistance not only in relation to impact assessments in developing states, but also in respect of assessments in other countries including EC Member States. It will be recalled that Member States are offered discretion to establish criteria or thresholds necessary to determine which projects are to be subject to assessment. In the event that a neighbouring Member State wishes to become involved in the process, it must be sent the information compiled by the developer. This information must be made available to the general public and relevant agencies in the country likely to be affected in a transboundary context, and an opportunity given to forward their opinions before development consent is granted.
