ABSTRACT

Both the Directive and the subsequent Town and Country Planning Environmental Assessment legislation divide new developments into two main groups: those for which an Environmental Assessment is mandatory, and those for which it is discretionary. The list of developments which must be the subject of Environmental Assessment are contained in Annex I of the Directive and Schedule 1 of the Town and Country Planning (Assessment of Environmental Effects) Regulations 1988. There are certain differences between the two lists, and it is interesting to compare them; how far the Council of Europe can enforce compliance with their own list of mandatory developments will become apparent after more projects have been through the Environmental Assessment procedures.

(1) Building or other operations or material change of use of land or buildings to provide:

Crude-oil refineries, installations for conversion of coal or bituminous shale at 500 tonnes per day or over.

Thermal power stations or combustion installations of 300 megawatts or over, nuclear power stations, nuclear reactors.

Installations solely for the permanent storage or disposal of radioactive waste.

Works for initial melting of cast-iron and steel.

Installations for extracting and processing asbestos at 20,000 tonnes per year or over, (and other asbestos processes).

Integrated chemical installations.

Motorways, express roads, lines for long-distance railway traffic, airports with runways 2, 100 m long or over.

Trading ports, inland waterways and inland waterway ports for vessels over 1,350 tonnes.

Waste disposal installations for processing or landfill of toxic wastes.

Crude-oil refineries, installations for conversion of coal or bituminous shale at 500 tonnes per day or over.

Thermal power stations or combustion installations of 300 megawatts or over. Not nuclear installations.

Installations solely for the permanent storage or disposal of radioactive waste.

Works for initial melting of cast-iron and steel.

Waste disposal installations for incineration or chemical treatment of special wastes.
