ABSTRACT

The law to be applied in Australia in deciding issues of causation in the law of tort is settled by March v Stramare .1 In most situations, a sufficient causal connection between an act of negligence and an injury is established by showing that the plaintiff would not have sustained the injury complained of but for the negligence of the defendant, or had the defendant not been negligent. That test, however, is neither a comprehensive nor an exclusive criterion for liability. There are situations in which a closer analysis of the question of causation must be made.
