ABSTRACT

Effectively administering a design contract involves three activities. The first is establishing the various baselines against which the owner will monitor the designer's performance. The second is conducting an active monitoring program. The third is taking appropriate measures if the designer is not complying with the requirements of its contract. The chapter starts by discussing each of these activities, and covers additional services. If there is a schedule included in the design agreement, and failing to meet the schedule has serious consequences under the design agreement, then additional service proposals may also include requested adjustments to the schedule. The chapter explains how to minimize the number of additional service proposals; how to analyze those that are submitted; and how to value those that have merit. It discusses the designer's standard of care, which is the obligation of the designer to the owner to use care that arises as a result of the designer's performance of its services.
