ABSTRACT

Chapter 3 provides a contextual analysis of exploitation in the doctor-patient relationship, which we present as an intimate and confidential professional relationship with trust and a power imbalance at its core. Given that this relationship can be situated in both public and private health care systems in the UK, we explore how the nature of the relationship, and the opportunities for exploitation, might be affected by each system. In considering how the law categorises exploitation in the doctor-patient relationship, we introduce the relevance of undue influence both as a legal doctrine, and as a conduit through which exploitation can be perpetrated.
