ABSTRACT

This chapter discusses the sales arrangement arguably the least regulated part by the Ordinance among all commercial practices in first-hand sales of residential properties. With more degree of freedom granted to the vendor, more questionable practices had arisen in this area. The chapter explains why issues regarding sales arrangement were heavily featured in the Consumer Council's 2014 Study. The deficiency has been much compensated with the issue of a number of practice notes by the Sales of First-hand Residential Properties Authority (SRPA). The practice of the employment of the 'consumption table' in the sales office has indeed encouraged developers to go the extra mile after fulfilling the requirements under the Ordinance in order to enhance transparency and fairness in the sales. The degree of enhanced regulation requires sensible consideration by the Authority to balance the necessary degree of discretion to be enjoyed by the vendor in order to arrange the sale; and the degree of risk of occurrence of misleading.
