ABSTRACT

In Hong Kong, land may be granted for both private and public purposes. In a land sale or land grant, any government bureaux or departments may propose the inclusion of public facilities to meet public needs; the developer may also propose such facilities in their planning applications to the Town Planning Board. Apart from passive obligations, the deed of mutual covenant may also contain positive covenants, example, to share expenses and costs for construction and maintenance of infrastructure outside the building. Such responsibility may be derived from the land grant conditions (LGC). According to the Development Bureau, public facilities within private developments can broadly be categorized into four groups: (i) Government, Institution and Community (GIC) facilities such as community halls, elderly centres, kindergartens and so on.; (ii) public open spaces (POS); (iii) pedestrian passage and vehicular access, example., walkways, footbridges and rights of way; and (iv) Public Transport Terminus.
