ABSTRACT

The expert’s report is a key part of the evidence that an expert provides and presents at court. Hence, time and care must be taken to ensure a report is properly prepared on the subject matter, as per the instructions the expert receives within the expert’s area of expertise and in keeping with the court procedure rules and according to the jurisdiction. A report is written by an expert to help the parties in the preparation and settlement of the case and/or to help the court to arrive at a decision. The Civil Procedure Rules and Practice Direction therein set out the detailed requirements for experts’ reports. These include the requirement in reports of a statement that the expert understands their duty to the court and has complied with that duty and that the report contains the ‘statement of truth’.
