ABSTRACT

A detailed survey of the laws, mostly federal, that set forth requirements for the protection of the environment and the criminal sanctions for a violation of those requirements are discussed. The discussion outlines the basic provisions of federal environmental protection laws, including the Clean Water Act, Clean Air Act, Rivers and Harbors Act, Safe Drinking Water Act, Resource Conservation and Recovery Act, Toxic Substances Control Act, Comprehensive Environmental Response, Compensation, and Liability Act, Federal Insecticide, Fungicide, and Rodenticide Act, and the Endangered Species Act. The chapter also discusses the elements that must be proven by the government in order to establish criminal liability against corporations and individuals and concludes with two case studies involving the application of the responsible corporate officer doctrine.
