ABSTRACT

The previous chapter discussed the absence of capable guardians to protect the environment as a factor in the commission of environmental crime of the violation of a regulatory offense. This chapter briefly discusses those “guardians” who have the responsibility, or in the case of non-governmental agencies, those guardians that have assumed a responsibility to protect the environment. The discussion concludes with a case study illustrating the success that can be achieved through federal and state cooperation, in this instance, the enforcement of laws and regulations designed to prevent the dispersal of waste from fracking.
