Pretrial publicity could impact the fair trial rights of someone on trial. Courts attempt to strike a balance between the fair trial rights of the accused and the rights of the free press. Judges can use contempt of court to get what they want. “Gag orders” can be imposed on trial participants. Reporters have gone to jail for refusing to testify in court or before grand juries. Shield laws are an attempt to protect reporters refusing to testify. Cameras are allowed in many state courts under specific criteria. Closing criminal trial courtrooms is highly unlikely.
