ABSTRACT

Government censorship is sometimes considered constitutional under United States law. The Supreme Court must ensure First Amendment rights for dissenters are protected. Standards of judicial review are used to evaluate controversial laws. Courts employ a variety of tests to determine the constitutionality of laws. Tests such as the clear and present danger test are applied to political opinion. Legal restraints have been used to silence political dissent in the United States. Some forms of sedition are subject to control, and some are not. First Amendment protection may differ in the workplace from other public venues.
