ABSTRACT

Collisions and groundings are the most common accidents at sea. The "collision" usually implies a yacht coming into contact with another yacht or a dock or object. The time bar for actions against the yacht owner or that of a claim by a yacht owner against another shipowner in a collision case is two years. Problems may arise between the salvor and the yacht owner. Clearly the recognition of a right to a salvage reward does not by itself resolve the manner in which the operation should be performed, the respective obligations of the salvor and the salvee, or the place and the time when the property or yacht is to be redelivered to its owner. The 1996 Limitation of Liability for Maritime Claims Convention, Article 1, prescribes that "shipowners", salvors, persons for whose acts the shipowner or the salvor are responsible and the insurers of particular liabilities have the right to limit their liability.
